Information pages– The planning process

Unlike UK laws it is the responsibility of the owner to ensure that all building permits are established and in place before any construction work is started. An application must be made by the owner or by their representative, or project manager, or by a person with a title permitting building or by a person able to benefit from the exploitation of the land for a public service. There are four types of planning documents that you need to be aware of:-

 

¨ Declaration of Works  - Une Declaration Prealable

¨ Planning permission – Permis de Construire

¨ Permission to develop – Permis d’Amenager

¨ Permission to demolish – Permis de Demolir

You will be required to complete at least one of the above documents for building work , for major works to an existing building or for demolition of an existing building or structure. Smaller projects such as a re-roof will only require a declaration of intended works known as Une Declaration Prealable. If in doubt as to the specific type of consent  required you should check with the local mayors office ‘Mairie’ or the DDE before starting work.
